These Terms of Service ("Terms") govern your access to and use of the website and products of Outbuiltit Technologies ("Outbuiltit", "we", "us", or "our"), including Outbuiltit. By creating an account, subscribing, or otherwise using our services, you agree to these Terms. If you are accepting on behalf of a business, you confirm you are authorised to bind that business.
1. What Outbuiltit is
Outbuiltit is a subscription software service (SaaS) for beauty parlours and salons. It answers customer enquiries, books appointments, manages a lane-aware calendar, sends reminders and broadcasts, and provides an admin dashboard — running on the official Meta WhatsApp Business Platform. Outbuiltit costs ₹999 per month, with every feature included. The first month is free, billing is monthly, and you can cancel anytime.
2. Your account & responsibilities
- You are responsible for the accuracy of the information you provide and for keeping your account credentials secure.
- You must comply with Meta's WhatsApp Business Policy and Messaging Guidelines when using the service.
- You are responsible for obtaining valid opt-in consent from your end-customers before sending them messages, and for honouring opt-out requests.
- You are responsible for the lawfulness of the content you send and the services you advertise through Outbuiltit.
3. Acceptable use
You agree not to use our services to:
- Send spam, bulk unsolicited messages, or messages without consent.
- Distribute illegal, harmful, deceptive, or infringing content.
- Scrape, reverse-engineer, or attempt to extract data from the service other than your own.
- Interfere with, overload, or attempt to gain unauthorised access to our systems or to Meta's.
- Violate any applicable law or third-party rights.
4. Payment, free month & cancellation
- Your first month is free. After that, the subscription is billed monthly at ₹999 (plus any applicable taxes) until you cancel.
- You can cancel anytime, effective at the end of your current billing period. There is no long-term lock-in.
- Because there is a free first month and no long-term commitment, fees already paid for a started month are generally non-refundable. We will handle genuine billing errors fairly — contact us and we will sort it out.
5. Third-party services
Outbuiltit depends on third-party services, including Meta (the WhatsApp Business Platform) and payment gateways such as Razorpay. Your use of those services is also governed by their own terms and policies. We are not responsible for outages, changes, or actions taken by those providers, including Meta's enforcement of its own policies against your WhatsApp account.
6. Intellectual property
Outbuiltit owns all rights in Outbuiltit, our website, and our software, branding, and documentation. You receive a limited, non-exclusive, non-transferable right to use the service while your subscription is active. You retain ownership of your own data, including your business information and your end-customers' data; you grant us the rights needed to process that data to provide the service, as described in our Privacy Policy.
7. Service availability & "as is"
We work hard to keep Outbuiltit reliable, but the service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not guarantee that the service will be uninterrupted, error-free, or that it will meet every specific requirement.
8. Limitation of liability
To the maximum extent permitted by law, Outbuiltit will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the three months before the event giving rise to the claim.
9. Indemnity
You agree to indemnify and hold Outbuiltit harmless from claims, damages, and reasonable costs arising from your use of the service in breach of these Terms, including messages you send without proper consent or content that infringes third-party rights.
10. Termination
You may stop using the service and cancel at any time. We may suspend or terminate access if you breach these Terms, if required to protect our service or comply with the law, or if a third-party provider (such as Meta) requires it. On termination, your right to use the service ends; data handling after termination is described in our Privacy Policy.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the service after changes take effect means you accept the updated Terms.
12. Governing law & jurisdiction
These Terms are governed by the laws of India. Any dispute arising from them is subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu, India.
